The Law on Copyright and Related Rights was adopted in Parliament

07/28/2022

The Law on copyright and related rights was adopted on July 28, in Parliament, in the second reading. The new act fully or partially transposes the European directives in the field of copyright, thus establishing the national normative framework capable of offering authors and holders of copyright and related rights firm guarantees of protection and exploitation of the rights held.

The law adopted today in the Parliament also aligns the national legislation with the provisions of the Beijing Treaty on Audiovisual Performances and the Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually Impaired, or Otherwise Print Disabled, international documents administered by the World Intellectual Property Organization to which the Republic of Moldova became a party in 2015 and 2018, respectively.

The adopted normative framework aims to ensure high standards of governance, financial management, transparency and reporting, which will determine the establishment in the Republic of Moldova of a regime of protection and respect for copyright and related rights similar to that existing in the European Union, for the benefit to all interested parties.

The new law is a response of the authorities of the Republic of Moldova to the emerging need to modernize the rules regarding copyright and related rights by creating a balanced and favorable system that corresponds to the requirements of the digital environment and the opportunities offered by new services for the exploitation of creative content, such as services of music streaming, video platforms, satellite television, etc.

We are certain that the new regulations will stimulate the creation and dissemination of creative digital content and allow for the expansion of its use by society, while rewarding creative effort and other fundamental rights.

The law enters into force within one month from the date of publication in the Official Gazette of the Republic of Moldova.
