The Appeals Board of the State Agency on Intellectual Property of the Republic of Moldova is an administrative body responsible for extrajudicial settlement of disputes on intellectual property protection.
The Appeals Board settles the following disputes:
- on the decision to reject the application for the registration of a trademark, an appellation of origin, a geographical indication or a traditional specialty guaranteed, issued in accordance with the outcome of the formal examination;
- on the decision to reject the patent application (invention or plant variety), to register an industrial design, taken in accordance with the outcome of the preliminary examination;
- on the decision to reject the patent application (invention or plant variety), taken in accordance with the outcome of the substantive examination;
- on the decision to reject the application for the registration of a mark, an appellation of origin, a geographical indication or a traditional specialty guaranteed, issued in accordance with the outcome of the examination of the requested designation, including the final decision to reject the application for the registration of a mark based on the outcome of the examination of the required sign under paragraphs 1, 2 and 5 of Article 5 of the Madrid Agreement;
- on the grant of a patent (invention or plant variety);
- on the registration of an industrial design;
- on the registration of a mark including the registration under paragraph 6 of Article 5 of the Madrid Agreement;
- on the registration of an appellation of origin;
- on the registration of a geographical indication;
- on the registration of a traditional specialty guaranteed;
- on the refusal of registration of a license contract;
- on the refusal of registration of an assignment contract;
- on the refusal of registration of a franchising contract;
- on the rejection of the application for amendment;
- on the priority of payment and amount of the fee, missed / repeated deadlines under the new circumstances partly or entirely rejected by the examination;
- the restoration /reinstatement of rights;
- other disputes assigned to the Appeals Board within its competence.
Natural persons or legal entities resident in the Republic of Moldova may lodge appeals. Foreign natural persons and legal entities or their representatives shall lodge appeals, correspond with the Appeals Board and attend meetings through the patent attorneys registered with the AGEPI.
The time limit within which an appeal is examined shall be three months from the date of its lodging.
The fee for lodging an appeal with the Appeals Board is 150 euros.
The fee for filing an application for reinstatement / restoration of rights is 100 euros.
The decision of the Appeals Board of AGEPI may be challenged in courts under their jurisdiction.
