The Government of the Republic of Moldova approved, today, September 10, the draft Government decision to amend some Government decisions (adjustment of the normative framework in the field of trade secret protection), presented at a meeting of the Executive Committee by Natalia Mogol, Deputy Director General of the State Agency on Intellectual Property,.

These normative amendments were initiated following the entry into force of Law No 384/2023 on the Protection of Trade Secrets, developed to transpose the provisions of Directive (EU) 2016/943 into national legislation.

In order to strengthen the normative framework in the field of trade secret protection and align the related normative provisions with the provisions of Law No 384/2023, the approved act amended some Government decisions, which contain references to the title of the repealed normative act, in order to update its title, namely: Law No 384/2023 on the Protection of Trade Secrets, and also to standardize the terminology used in the context of the new adopted act, for the appropriate definition of the concept of trade secret and the legal regime for its protection.

Thus, the approved amendments will provide for the framing of Law No 384/2023 on the Protection of Trade Secrets in the context of the normative framework in force and the correlation of its provisions.

Aceste modificări normative au fost inițiate ca urmare a intrării în vigoare a Legii nr. 384/2023 privind protecția secretelor comerciale, elaborate pentru a transpune în legislaţia naţională prevederile Directivei (UE) 2016/943.

În scopul consolidării cadrului normativ în domeniul protecției secretelor comerciale și racordării prevederilor normative conexe dispozițiilor Legii nr. 384/2023, prin actul aprobat au fost amendate unele hotărâri ale Guvernului, care conțin referințe la denumirea actului normativ abrogat, în vederea actualizării denumirii acestuia, și anume: Legea nr. 384/2023 privind protecția secretelor comerciale, dar și a uniformizării terminologiei utilizate în contextul noului act adoptat, pentru definirea corespunzătoare a conceptului secretului comercial și al regimului juridic de protecție a acestuia.

Astfel, prin amendamentele aprobate se va asigura încadrarea Legii nr. 384/2023 privind protecția secretelor comerciale în contextul cadrului normativ în vigoare și corelarea prevederilor acestuia.
