Amendments to the Regulations under the Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks

A number of amendments to the Implementing Regulations under the Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks entered into force on November 1, 2022.

What is new?

APPOINTMENT OF REPRESENTATIVES

As of November 1, 2022, it will no longer be able to appoint a representative in signed letters/messages. All applications will be submitted through the “Management of the Representative” online service in eMadrid.

Important! Although the appointment of a representative can still be made through the downloadable forms of the Madrid System, it is strongly recommended to use the eMadrid online services.

Note: Applicants have the option to appoint a representative when submitting an international application (eMadrid online services or form MM2). New holders (transferees) can use the “Change in ownership” column in eMadrid (or form MM5).

RENEWALS

For more flexibility, renewal of international registrations is possible as early as six months before the expiry date. In addition, once all required fees have been paid, the renewal will be inscribed, the renewal certificate will be issued and all designated parties will be notified.

Note: The renewal date remains the expiry date of the mark.

Important! To make sure that the renewal certificate contains all up-to-date information, any changes to the international registration must be made prior to renewal using eMadrid.
